Ice & Embers Recovery Garden – Terms & Conditions and Liability Waiver

These Terms and Conditions (“Terms”) apply to all bookings and use of facilities at The Recovery Garden. By making a booking, you confirm that you have read, understood, and accepted these Terms on behalf of yourself and all persons included in your booking (“Participants”). You also confirm that you will communicate these Terms to all Participants before attending.

1. Assumption of Risk

1.1 You understand that the use of sauna and cold plunge facilities carries inherent risks, including but not limited to: slips, falls, burns, fainting, cold shock, frostbite, heat exhaustion, dehydration, cardiovascular events, illness, injury, or death.

1.2 You and all Participants voluntarily assume full responsibility for all risks, whether foreseeable or unforeseeable, that may arise from your participation.

2. Comprehensive Waiver of Liability

2.1 To the fullest extent permitted by law, The Recovery Garden, its owners, employees, contractors, and agents accept no responsibility or liability for any injury, illness, death, loss, theft, damage, or expense of any kind suffered by you or any Participant, whether arising directly or indirectly from:

• Use or misuse of the facilities.

• Failure to follow safety instructions or guidelines.

• Acts or omissions of other customers or staff.

• Environmental factors, weather conditions, or unforeseen circumstances.

• Theft, loss, or damage to personal property, including vehicles and contents.

2.2 By booking, you release, discharge, and hold harmless The Recovery Garden from any and all claims, demands, causes of action, or liabilities, whether in contract, tort, or otherwise, except in cases of proven gross negligence or wilful misconduct.

3. Personal Responsibility

3.1 You and all Participants are solely responsible for:

• Assessing your own health, fitness, and medical condition before use.

• Consulting a medical professional if you have pre-existing conditions.

• Deciding whether participation is safe and appropriate for you.

• Bringing suitable swimwear, towels, hydration, and personal items.

3.2 You confirm that you and all Participants are not under the influence of alcohol, drugs, or any other impairing substances while using the facilities.

4. Bookings and Cancellations

4.1 Bookings are confirmed only once full payment is received.

4.2 Bookings are non-transferable and non-refundable unless otherwise stated in our cancellation policy [link or details].

4.3 The person making the booking is financially and legally responsible for all Participants included in their group.

5. Behaviour and Conduct

5.1 All Participants must treat staff, facilities, and other customers with respect.

5.2 Unsafe, disruptive, or inappropriate behaviour will result in removal from the premises without refund.

5.3 All instructions from staff and posted signage must be followed.

6. Minors

6.1 Sessions are strictly for ages 18 and over.

6.2 Persons aged 16–17 may only attend if:

• They are accompanied and supervised by a parent or legal guardian; and

• The parent or legal guardian has booked the session and accepted these Terms & Conditions and Liability Waiver on the minor’s behalf.

6.3 The parent or guardian accepts full responsibility for the minor’s participation, safety, wellbeing, and conduct at all times, and agrees that Ice & Embers Recovery Garden assumes no liability for any injury, illness, death, loss, or damage arising from their attendance.

7. Personal Belongings

7.1 You are responsible for your own belongings.

7.2 The Recovery Garden accepts no liability for loss, theft, or damage to personal property, including items left in lockers, changing areas, or vehicles.

8. Governing Law

8.1 These Terms are governed by and construed in accordance with the laws of Northern Ireland.

8.2 Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
